Basic Court judge from Vranje dismissed after sex scandal: She claims this violated the Constitution

Marija Janicijevic, a judge at the Basic Court in Vranje, was dismissed from her job following a second instance decision of the High Judicial Council made on August 27.

She was dismissed for "violating the code of conduct of judges." Janicijevic remains employed until the decision has been published in the Official Gazette, but will not perform judicial work, said sources in the Vranje court.

The scandal that shook Vranje last year began when newspapers published nude photos of the young judge. The photos were allegedly taken by her then-lover Zoran Cvetkovic, who made a number of allegations against the judge, some of them related to the cases she worked on.

Marija Janicijevic herself claimed at the time that she was the victim of Cvetkovic's fraud, because he pretended to be a judge of the Supreme Court of Cassation. When she realized that she was deceived, she allegedly tried to break up with the suspect, but he started blackmailing her, which is why she sued him.

The disciplinary complaint over the sex affair involving the photographs and also because of a large number of pending cases she was working on was filed against the judge by the High Judicial Council president, Dragomir Milojevic, the daily Informer writes.

It was assessed that Janicijevic did not respect the code of conduct because she failed to uphold its reputation and dignity outside the Basic Court in Vranje. However, reportedly, the racy photographs are not the only problem - another is a large number of unresolved cases and those that have become subject to statute of limitations.

Janicijevic yesterday briefly commented to say that she initiated proceedings to review the constitutionality of the Law on Judges, because of its "inconsistency with the Constitution."

"The Constitution stipulates that the judicial function ends only after the Constitutional Court has ruled on appeal, which was not respected in this case, as the decision was made in both cases by the High Judicial Council, thus violating the Constitution," Janicevic told the daily Novosti.
