Constitutional Court in Pristina: Assembly has not been constituted, 12 days to elect Serb vice president

The Constitutional Court in Pristina announced on Tuesday its decision, stating that the provisional institutions' Assembly has not been constituted because the vice president from the ranks of the Serb deputies had not been elected.
The Constitutional Court ordered that the constitutive session of the Assembly be completed within 12 days.
As stated in the decision published on the website of that court, it was established that the constituent session of the Assembly, which began on April 15, was not completed because the Serb vice president was not elected, hence that the Assembly was not constituted in line with the provisions of the constitution of the provisional institutions.
It was ordered that the decision be published in the official gazette and that it will enter into force on the day of publication.
On Tuesday, the court's temporary measure issued on September 5 expired. It prohibited members of the Assembly from taking any action or decision, as well as suspended procedures to form a government.
The measure was issued after the Serb List filed a complaint on August and requested an assessment of the constitutionality of the election of the vice-president of the assembly from non-majority communities.
Although the Assembly of the provisional Pristina institutions did not elect a vice-president from the Serb community, the president of the assembly, Dimal Basha, announced that the constitutive session had concluded.
The vice-president from the Serb community was not elected because the majority of deputies refused to support Slavko Simic, whose name was put forward by the Serb List, which has the right to propose a candidate for vice-president because it has nine out of the 10 parliamentary seats guaranteed to Serbs.
Basha also separated the voting for the vice-president from the Serb community and the vice-president from the ranks of other non-majority communities, which is contrary to the constitution and rules of procedure of the assembly in Pristina.
