President Vucic resigns, Serbian Assembly President Brnabic to take over as acting president of the republic

President of Serbia Aleksandar Vucic late on Sunday resigned from that position, and until the election of a new president, President of the Serbian National Assembly Ana Brnabic will be the country's acting president. She can remain in that office for a maximum of 90 days.

Vucic said last night that the presidential election, according to the Constitution and the law, will be held by the end of December, and that he will hand over his duties to Ana Brnabic on Monday.

As provided by the Constitution and the law, the mandate of the president of the Republic ends the moment the written resignation reaches the National Assembly.

As stated in the Law on the President, while replacing the President of the Republic, the President of the National Assembly is authorized to represent the Republic of Serbia at home and abroad, to receive letters of recall and credentials from foreign diplomatic representatives, to call elections for the National Assembly, to propose candidates for Prime Minister to the National Assembly, to exercise responsibilities in the field of defense of the Republic of Serbia and to command the Serbian Army.

Also, the President of the National Assembly who replaces the President of the Republic is under obligation to dissolve the National Assembly in all cases in which this is the constitutional duty of the President of the Republic and to declare every law passed with a decree.

The President of the National Assembly is also under obligation to announce elections for the President of the Republic.

As defined by law, if the term of office of the President of the Republic expires before the time period for which he was elected, elections are called so that voting takes place no later than three months from the day when the term expires.

No less than 30 nor more than 60 days can elapse from the day of announcing the election to the day of voting, and a non-working day is designated as the voting day.

Regular elections for the president of the Republic are held every five years, which is how long the president's mandate lasts, except in the case of extraordinary presidential elections, which are held when the president is prevented from performing their duty or their mandate ends early.

This can happen if the president resigns or a decision is made to terminate their mandate.
