The Court of Appeal in Belgrade, due to lack of evidence, acquitted Marko Kašnjeti (60) from Prizren, a member of KLA, of expulsion of Serbian civilians from that town in June 1999-it was posted on the website of that Court.

With that decision, the Court of Appeal reversed the first instance verdict after the main trial, which sentenced him to two years in prison, according to Tanjug.

Kašnjeti, as a member of KLA, was accused of committing a war crime against civilians on 14 June 1999 in an attempt to force the civilians of Serbian nationality to leave the area of the municipality of Prizren.

The event, according to the indictment, happened on 14 June 1999 in Prizren during the interruption of war between the military forces of the FYR and police forces of the Republic of Serbia, on one hand, and members of the armed military formation KLA and NATO coalition on the other hand.

The case against Kasnjeti was formed on the basis of photographs that the Office of the War Crimes Prosecutor received from the indemnifying party.

In the photograph, according to the Office, there was Kašnjeti with three more KLA members harassing civilians whose hands were tied with a wire on their backs, while hitting them with a rifle butt.

However, according to the findings of the Office, the evidence presented during the proceedings did not indicate with sufficient certainty that Kašnjeti was a person who was in a color photograph.

According to the further information by the Court, in the absence of direct evidence that would undoubtedly or with sufficient probability pointed to the defendant as a person who was in a highlighted photo, or that the he was the perpetrator of the crime, the Court found that there was insufficient evidence for conviction.

The Office of the War Crimes Prosecutor charged Kasnjeti with stopping a vehicle “Yugo 55″ with the indemnifying party in, on 14 June 1999 around 11 o'clock, ordered them to get out of the vehicle, searched them, took their personal documents, money and other valuables, hit one of them with the rifle butt on the head and tied their hands with a rope according to the indictment.

Together with other unidentified members of KLA, gun-pointed them and threatened to killed them. He conducted the trapped down the street to a yard of a house and hit them with rifle butt on the head and body. There they were illegally detained and held closed for several hours.

With an unidentified member of KLA, he took an indemnifying party to a Prizren neighborhood Ortokol, stopped the vehicle, threw them out, and ordered them to go to Serbia if “they wanted to stay alive”, and took their vehicle and all their possessions.
