On its path towards the European Union, Serbia will have to change its highest legal act, and how Telegraf.rs has come to learn, most changes in the Constitution of Serbia will be in part related to the judiciary, as well as the preamble that talks on the status of Kosovo and Metohija!

In order for Serbia to become a member of the European family of states, its Constitution will have to undergo certain changes, in addition to the change in the number of deputies in the Serbian Parliament, a significant amount of portions relating to the judiciary will be changed, but also the status of Kosovo and Metohija.

Prime Minister Aleksandar Vucic said that Serbia will have to amend the Constitution in the next two to three years, but that it will be necessary that the changes are in agreement with the entire society.

In the report of the European Commission on the screening for Chapter 23, it clearly indicates that Serbia on its path to the European Union (EU), should change their Constitution, as was done by Croatian for example and many other EU member states!

The screening report recommends that in amending the Constitution, it be approached very thoroughly to determine what needs to be changed. The basic assessment of the EU was that the political impact of the legislative power to the judiciary was, "too large and overly available". In this context, there was a requirement that Croatia, for example amend its constitution and that the policy be "removed from the judiciary", as will be the case with Serbia.

The Prime Minister: Serbia is NEVER going to recognize Kosovo but will be the member of EU!

Serbia will certainly have to change the Constitution in parts referring to the High Judicial Council and State Prosecutorial Council as well as to amend a provision prohibiting the extradition of its nationals to other countries, in order to implement the European arrest warrant.

In light of the possibility of changing the Constitution, the Director of the Office for Kosovo and Metohija Marko Djuric previously said that the Belgrade-Pristina talks consider the legal framework as something that is already given, but that at some point it has to fit the Association of Serbian Municipalities in the legal system in order for us to have legal certainty. He stressed that we can certainly expect changes in the Constitution due to European integration.

According to him, it is important that the Serbian Constitution provides the possibility to adopt a constitutional law related to Kosovo and Metohija.
